Warranty Exchanges and Returns Policy
At NAAK S.A.S., we have established the following policies for exchanges, returns, and warranties for our commercial establishments known as DEVIER. It is important to note that these policies are designed to complement and protect consumer rights, as stipulated by the Consumer Statute (Law 1480 of 2011).
DEFINITIONS:
QUALITY: As defined by the Consumer Statute, the quality of a product or service is the condition that a product meets the inherent characteristics and those attributed by the information provided about it. In Colombia, those who produce, import, or market a product or service have a duty to (i) ensure that it complies with the regulations and technical standards in place for its production or provision, and (ii) provide all available information so that the consumer can make an informed decision regarding their purchase.
SUITABILITY: Suitability is defined as the product or service's ability to meet the need for which it was produced or marketed. Safety refers to a product's condition in normal usage, durability, maintenance, and information provided, not presenting unreasonable risks to the health or integrity of consumers.
Thus, the obligation to respect the warranty arises when a product or service experiences a flaw or damage, i.e., when the quality or suitability conditions are affected.
WARRANTY: Warranty is an inalienable right of all consumers that cannot be limited by the free will of producers or marketers in the market. It should be enforced when the product, as mentioned earlier, is affected in terms of quality or suitability, with the corresponding repair by the supplier or marketer, or if possible, with the replacement with a product of similar characteristics or a refund.
Therefore, when there is no situation that warrants enforcing the warranty because the claim is unrelated to the quality or suitability of a specific product or service, it is not mandatory for the supplier or marketer to accept the return or exchange of the merchandise. They can always establish their own return or exchange policies in the manner they consider appropriate, with the timelines, restrictions, and limitations they see fit (for example, not allowing the exchange of personal care products, underwear, swimwear, promotional items), provided that sufficient, clear, and suitable information is provided to consumers in the market regarding such policies.
SHIPPING POLICY
COVERAGE:
NAAK S.A.S. delivers to all municipalities in Colombian territory through shipments with an affiliated company in the same city or in other cities, including cities around the world. The responsible company for ensuring security and coverage is ____________________. This ensures that your purchase reaches the desired address.
DELIVERY TIMES:
The delivery time for products is the same day in cities where DEVIER is present, between three (03) and seven (07) business days for major cities where DEVIER is not present, and between eight (08) and fifteen (15) business days for other destinations according to the shipping times required by the third party authorized by NAAK S.A.S. to complete the operation, International delivery will be thirty (30) days, delivery times may vary depending on the destination city and the authorized postal service. Deliveries cannot be scheduled for a specific time and must be directed to a specific and secure location, such as a home or office. During special occasions like Mother's Day, Christmas, Black Friday, or sales events, delivery times may increase and are subject to the carrier's service availability.
Delivery times start from the approval of payment through the virtual or telephone platform, which will occur once the financial institution or another entity responsible for the payment method used confirms the availability of funds. It may be affected by force majeure events, as well as the location and day/time of the purchase.
Upon payment approval, you will receive an email confirmation of the order. Subsequently, you will receive all shipping information via the same medium, including waiting times for receipt and details of the relevant financial transaction, along with the corresponding purchase invoice to ensure compliance with this warranty policy.
For the calculation of delivery times, you should consider the date and time of payment approval as follows, our payment platform Pay U should approve the transaction based on data analysis:
- Credit card payments and using the PSE button may take up to (1) business day for approval.
If you have any concerns about shipping or if your order does not arrive within the specified period, please contact us via our email customers@devierparfums.com, or the "Contact Us" form on the website. Don't worry, we will take care of resolving it and provide you with information as soon as possible. Our customer service hours are Monday to Friday from 8:00 AM - 5:00 PM.
The product can be received or inspected by any adult residing or present at the delivery location. Signing the carrier's guide will be sufficient.
If the product shows signs of damage or breakage in its packaging at the time of delivery, you must record it on the carrier's guide as an observation and immediately return the product while contacting us through our email customers@devierparfums.com (Monday to Friday from 8am-5pm)
SHIPPING COST:
The shipping cost will be determined based on the destination, weight, and package volume. The cost will be calculated at the end of the purchasing process and will be informed at the time of order settlement before you make the payment.
Notwithstanding the above, NAAK S.A.S. reserves the right to omit or modify shipping charge limits, and, in any case, this amount will be announced before accepting the order and payment from the customer.
PERFUMERY PRODUCT WARRANTY:
DEVIER offers a warranty for products purchased in our stores in case they do not meet the quality and suitability standards set by the manufacturer. Customers have the right to request a warranty for fragrances in the following scenarios:
- Leakage of the perfume in the container.
- Damage to the dosing valve.
- Alterations in the content due to liquid deterioration.
- Presence of impurities or fungi in the content.
- Empty fragrance container or with physical defects that affect its normal use, such as scratches, dents, patches, broken glass, and other related issues.
- Alterations in the fragrance color.
To request the warranty, the customer must return the product to the store where it was purchased, in its original and undamaged packaging, without any additional use, and report the defects. In addition, the sales receipt or any document certifying the purchase from DEVIER stores must be presented.
The warranty for perfumery products has a duration of THIRTY (30) calendar days from the date of purchase. Warranty requests will not be accepted in case of damages caused by improper use of the product, third-party interference unrelated to DEVIER or the manufacturer, or in other cases provided by law.
All warranty requests must be submitted within the validity period and comply with the conditions established in this document. They will be evaluated by the customer service department and the brand consultant, who will determine whether the warranty is applicable within a maximum of 15 business days. If the warranty is denied, the consumer will be informed of the reasons for the decision.
The replacement product will be delivered within 10 business days, subject to inventory availability at the store where the claim was made. If necessary, DEVIER may inform the customer if an additional period is required. The replacement product will be delivered at the store where the claim was made or at the DEVIER sales point, as determined.
WARRANTY CLAIM EXCEPTIONS:
Perfumery products do not have the same fixation on everyone's skin due to factors such as skin type, weather conditions, pH, medications, hormonal changes, or dietary changes. Therefore, there are no warranty claims for product fixation issues.
2. NON-WARRANTY RELATED EXCHANGES:
In cases unrelated to the product's warranty, DEVIER may accept the product's exchange at its discretion. The following conditions must be met:
The product must be in the same condition as received, with its original packaging, labels, security seals, and all parts and accessories. It should not have dents, scratches, breakages, stains, or malfunctions different from product or manufacturing defects. If it has cellophane, it must be in perfect condition for resale. Refunds will not be accepted; instead, DEVIER will offer a replacement product of equal or better conditions, with the customer paying the price difference when it's the latter scenario. Likewise, if the customer cannot find a product they like, a capital representative voucher will be issued, redeemable within six (6) months from its issuance.
Products damaged by customer mishandling will not be eligible for exchange. Exchanges of fragrances for customer preferences or fixation issues will not be accepted. Exchanges of promotional products or gift sets will not be accepted, except for warranty claims. In this case, the customer must return all the products included in the offer, including gifts and miniatures if they were provided at the time of purchase. If the exchange is accepted, the customer will have the right to a product of equal characteristics and value. If a higher-value product is requested, the customer must pay the difference between the price paid and the new product's selling price. Exchange requests must be made within a maximum of 5 days after the purchase and are subject to the discretionary decision of DEVIER's personnel.
3. RIGHT OF WITHDRAWAL FOR ONLINE PURCHASES:
In accordance with Article 47 of Law 1480 of 2011, consumers who purchase any product through our website at www.devierparfums.com or through remote contact channels have the right of withdrawal within FIVE (5) business days following the receipt of the product.
To exercise the right of withdrawal, the customer can request a refund within the mentioned period. They should send an email to customers@devierparfums.com with the subject "RIGHT OF WITHDRAWAL." In the email, they must provide their information, the purchased product, the date of receipt, and attach a copy of the receipt and a copy of their identification.
The refund will be made within a maximum of THIRTY (30) calendar days from the date the request was submitted. If the purchase was made with a credit card or through PSE, the refund will be made to the same credit or debit card used for the purchase.
The customer must return the purchased product in the same condition as received, in perfect condition, with its complete packaging, seals in good condition, and unused, without any breakages. The product should be sent by the customer to DEVIER's offices located at Calle 30 # 4 A-45 Edificio Forever
W&L Oficina: 506 Medellín, Colombia, in Medellin. The transportation costs for returning the product will be covered by the consumer.
4. PAYMENT REVERSAL:
As indicated in our Terms and Conditions document, the law states that in sales made through electronic commerce mechanisms, such as the Internet, and where a credit card, debit card, or any other electronic payment method was used for payment, the parties involved in the payment process must reverse payments requested by the consumer in case of fraud, unsolicited operations, non-receipt of the purchased product, delivery of a product that does not match the order, or defective products.
To initiate a payment reversal, the consumer must submit their request to NAAK S.A.S. within five (5) business days from the date when they became aware of the fraudulent or unsolicited operation or should have received the product, or upon receiving a defective or incorrect product, and return the product if applicable.
To process the return of products (in cases where they have been delivered), NAAK S.A.S.'s Customer Service department will coordinate with the customer for the date and time when the transport company will collect the product.
This policy complies with the Consumer Statute of Colombia, Law 1480 of 2011.
